There is an interesting book:
It's here for $210 (http://www.abebooks.com/American-soldier-sailor-pictorial-history-campaigns/10324077140/bd)
1898. Copyrights long expired.
This eBay seller:
PeriodPaper (http://feedback.ebay.com/ws/eBayISAPI.dll?ViewFeedback2&userid=periodpaper)
Bumped into a copy. They're selling copies of the photos included. Interesting photos. No, I'm not pushing people to buy them as they're expensive - you'd be better off buying the book itself.
The point is you can't copyright a scan of an old photo which isn't copyrighted.
Click the "View items for sale" from that seller.
Type "1898 War" in the search box.
Lots of interesting photos of the SpanAm War. The variety of uniforms is incredible.
Rayg? Interesting Lee photos. One includes the belt and suspenders getup you have.
There is a very detailed photo of a Krag action in that set. Krag, trapdoor, and Lee.
