Person in position of authority it could be. If a person is 18 legally an adult how can charge be filed unless the 18 year old was MRDD.

She's not in trouble because of the age difference. She's in trouble because it's one of her STUDENTS. I don't see her getting 5 years for that but she did betray a certain trust. Kiss her job goodbye.
Now, when I was 18 I met a cute gal a little older than me. I thought she was in her mid 20's and she thought I was in my early 20's. Turned out she was 31...but dang she was HOT!

Assuming they're not going at in the classroom, then when class is out
surely he's no longer technically a student.

she is a person of influence, much like a preacher taking advantage of someone whom they are counseling. teachers or preachers, anyone who is in a position of power above you , should keep their hands off.

Being a person in "authority" of position of power is a tough thing. My former profession had many ethics consideration when dealing with a client. Under NO WAY could a personal consideration come into play where anything could be accepted by the clinician. A simple drink of water could be considered an act of "love" by a female client or a position of power by a male client. It was OK to buy the client lunch in public, never to do anything in private or off hours. I used what I called the three tiered consideration when dealing with a client or their family member. From anyone else observing, what I was doing for the client was it ethically [according to the American Psychiatric Association standards], my Christian Morales, state of Ohio/Federal legally acceptability? For myself there was no shades of gray, only black and white. Over the many years I saw cohorts lose jobs, licenses, personal family relationships due to violations of the code of ethics. Off duty if I got a phone call of an arrested client I documented on a client form that I kept in my kit so maintain ethical standards, if it wasn't documented it never happened no matter how trivial. This teacher deserves to be punished for breaking codes of ethics.

However a President of the U.S. cannot be described as a person "who is in a position of power..." when it comes to schmucking a intern. That is just fine and dandy. Right?

Red, get with the program. We are now a nation of double standards which is dependent upon ethnicity, popularity, wealth, and political leanings.
