    Illegal Alien's illegal gun carry decision overturned?

    Has anyone heard that the illegal alien that shot the girl in San Francisco just had his conviction for illegal gun possession overturned? I heard it briefly on Fox this morning, but could not believe that the State of California that hates misuse of firearms so much would do this.

    It's the possession of guns by HONEST people that California objects to.

      Actually, I think the dems have proven they don't care about the crime issue. They need to disarm America to push their political/social agenda.

        there was a technicality used, something along the lines of he found or picked it up vs owning or having in his possession IIRC, , and the courts tossed it out,

              About 40 years ago it was ruled that ex-cons do not have to register their guns and can't be charged for not registering. It is a violation of the ex-con's 5th Amendment Rights.

                I'm confused. I thought "ex-cons"(kinda like an ex-Marine?) were felons and felons couldn't own firearms. I'm not real up on that. I've only been charged with misdemeanors.

                  That was the point of the ruling. If an ex-con has a gun, you can't force him to admit it -- so you can't force him to register it.

                  As I recall, that was extended to income tax -- if you make money by illegal gambling, you can't be forced to declare it.

                    You are right on the owning part unless their right to own firearms is restored. Many get busted daily for having a weapon under disability to add to other charges. I always felt that adding this charge is like adding a peeping Tom to a rape charge. DA love to pile charges on when the base charge could do, often just to add time or leverage.

                      Adding time is a worthy goal -- an ex-con with a gun is dangerous and the longer he's locked up, the better.

                        The dems love their criminal clients. Possession of a firearm by a felon is almost never prosecuted. The dems want to restore voting rights to felons. Their voter fraud schemes are slowly being outlawed.

                          Not sure voting is really a concern of a person who has lost the right due to criminal conviction.

                            Hopefully outlawing their schemes, reducing the number of illegals that vote, truthful census polls and other conveniences will reduce the amount of democrat leaning fraud come the next election.
