People who are coming in legally have to remain in their own countries until they are granted entry.
But apparently the 9th Circus figures it's better to just border jump illegally and by-pass the Constitution. According to a, 2- 1 decision, both Obama's appointments.

This will go to the Supreme court where it will be over ruled and the liberal justices will cry again and complain about the Lump bringing to them before an appeal to the whole 9th circuit court.

Since it is a 3 judge panel of the 9th Circuit the government can argue for it to heard en banc, i.e. by the whole court. Several have noted that Trump appointees have tilted that court to the right.
