It will proceed to the Supreme Court ... where it will be decided. Until then, it is merely in process. Sincerely. bruce.

The opinion in the 3rd Circuit was penned by a Trump judge.

So the rule prohibiting online diagnoses not implemented yet, correct?

Another of the many indications that the Dem's desire to pack the court has little to do with fairness and everything to do with promoting an agenda.

The Federalist Society doesn't have an agenda?

It has been said that the US Constitution is a founding document of liberalism. Many passages are literally quite liberal, and the anti-liberalism (not the same as conservatism!) that is part of the modern world does not find real support in the Constitution.

The point was Republican judges are not, in fact, agents of the Anti Christ and have, for the most part been more than fair to the Dems. Unfortunately judges on both sides are now being picked for ideology (on both sides) and qualification has little to do with the process right now.

Of course the Republicans have an agenda, but the Democrat claim that the Republican judges are going to take the United States back to the dark ages has been proven incorrect over and over. The Democrats are largely to blame for the situation they're in. Ruth Bader Ginsberg should have retired when Obama asked her to and had the votes to replace her. Harry Reid and the Dems changed the Senate rules abolishing the filibuster for all Federal appointees other than Supreme Court Justices. This gave "the turtle" the opening he needed to change the rule for Supreme Court Justices when Chuckie Schumer stated directly that no Trump justices would be approved and promptly filibustered Justice Gorsuch. The treatment of Cavanaugh cost the Democrats three Senate seats in 2018 and any chance they'd have had to block Republican appointees. Even if the Democrats win the two seats in Georgia Dems from deep red states like like Tester, and especially Manchin may not play ball.

The Constitution of the United States is not really a liberal document. If anything its a libertarian document that was radical for its day.

McConnell surely had something to do with it. It doesn't all go back to Reid. In any case the Senate has now shown itself to function no better than the House did when they were having their quorum battles in the 1890s. In general this suits McConnell's tastes, because the things that require passage....judges and budgets, no longer need 60. But garden-variety legislation does, to end debate. So a once rare practice of the filibuster becomes commonplace, and like any weapon that sees heavy use, it demands countermeasures. But the filibuster suits the conservative mindset of the present age, which is that no new laws are on average better than new laws. This state of affairs also reinforces the idea that democratic (small d) governments are not responsive to the needs of the people, giving openings to certain types of politicians on the right.

It tells you everything you need to know that McConnell pursued tax cuts and judges and nothing else for 4 years. There was nothing else that interested him, no problems in the land where in his mind Congress could act through legislation to further the interests of the nation.
